Independent Legal Advice, known as (ILA), is used when customers take formal advice from a Solicitor or Chartered Legal Executive who isn’t involved in the original proceedings. The Solicitor or Chartered Legal executive will provide the customer with guidance regarding their circumstances. Once the advice has been given, a legal document is produced, which needs to be signed by the customer, stating they fully understand the advice given.
Some of the most common transactions requiring Independent Legal Advice includes:
- Buy to Let Limited Company
- Equity Release (lender requires client to get ILA)
- Director Mortgage Guarantee
- Joint Mortgage Sole Proprietor
- Guarantee for lease extension
- Bridging (Lender requires the client to get ILA)
- Transfer of Equity
- Occupier Waiver
- Property Settlement Agreements
